On July 20, 2018, the regulations for granting loans to workers entitled to the Infonavit benefit were published on the Federal Official Gazette.
Added to these rules is the “Housing Mobility Loan”, which consists on granting the loan to active or inactive entitled workers, allowing them to change residence in the event of damages to their home due to natural disasters, when these are located at Emergency Zones, upon filing a proof of damage issued by the competent federal or state authorities, or by professionals authorized by INFONAVIT.
There is no minimum age requirement, or a given number of bimesters on record, and in the case of inactive rightful claimants, a minimum period elapsed since having a labor relation, or the payment of a commission.
Rightful claimants obtaining a Housing Mobility Loan in the event of natural disasters shall evidence the use of the funds with a representation, under oath, that the loan amount shall be used for the reconstruction, increase or repair of the dwelling.
The Housing Mobility Loans may be granted in a conjugal manner, provided both spouses meet the respective requirements.
Regarding active rightful claimants, subsequent contributions made by the employer shall be used to re-establish the housing sub-account. For inactive rightful claimants, if they start working again, contributions in their favor shall be also used to re-establish the housing sub-account.
This loan modality shall only apply to serve the emergencies due to natural disasters that took place during September 2017 and the term shall be until March 30, 2018 or until the sum of one thousand million pesos is spent, whichever occurs first.
